I only see three people standing there so I don't know who else your talking about but I think Hank Pym should be in this scene.

And this is probably something that relates to 42, IMO.

I can only assume that's 42 and that the other person is Hank Pym, as he's the only othe KNOWN person working on 42 other than Stark and Richards.

Mutants
I believe all the mutants were grandfathered into the regestration act due to the mutant regestration act. I think I read that in the recent wolverine

Fourty Two is an expirement that Tony, Hank, and Reed are working on. Reed forbid himself to tell Sue, meaning it's probably some messed up project meant for the Anti SHRA Heroes.

I argee with some of the above respones saying it could be Pym or it may even be by the way the hair looks, our favorite wall crawler, Spiderman.
