OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO PERMANENT LEGAL RESIDENTS OF THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER.
  1. HOW TO ENTER: The "Be In A Marvel Movie Sweepstakes" ("Sweepstakes") begins at 3:00:00 p.m. Eastern Time ("ET") on April 16, 2007 and ends at 11:59:00 p.m. (ET) on August 17, 2007 ("Sweepstakes Period"). To enter, go to marvel.com/be_in_a_marvel_movie (the "Sweepstakes Website"). Then, fill in the online entry form and submit it in accordance with the on-screen directions during the Sweepstakes Period. All information requested (other than that designated as optional) must be provided or your entry will be disqualified. Limit of one (1) entry per person. All entries must be received by 11:59:00 p.m. (ET) on August 17, 2007. All entries submitted become the sole property of Marvel Entertainment, Inc. ("Sponsor") and will not be acknowledged or returned by Sponsor or RPMC, Inc. ("Sweepstakes Administrator"). Any use of automated devices is prohibited. Sponsor reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method.

  2. ELIGIBILITY: To enter the Sweepstakes you must, at the time of entry, be a legal permanent resident of the 48 contiguous United States or the District of Columbia who is 18 years of age or older and physically located in such states or the District of Columbia. Sweepstakes is void elsewhere and where restricted or prohibited by law. The Sweepstakes, and any web sites, web pages or advertisements relating thereto, are intended for viewing only within the United States. Entries received from persons residing outside of the eligible geographic areas, or where restricted or prohibited by law, will be disqualified. Employees, officers and directors of Sponsor and the Sweepstakes Administrator, and their respective affiliated companies, parents, subsidiaries and advertising and promotion agencies (collectively, "Sweepstakes Entities"), and members of the immediate families (parents, children, siblings and spouse, regardless of where they live) and households (whether related or not) of such employees, officers and directors are ineligible to participate in this Sweepstakes.

  3. DRAWING AND NOTIFICATION: The Sweepstakes Administrator, an independent judging organization whose decisions are final and binding in all matters relating to this Sweepstakes, will conduct a random drawing on or about August 24, 2007 to select potential winners of the prizes described herein. Odds of winning a prize depend on the number of eligible entries received during the Sweepstakes Period. Potential prize winners will be notified by telephone, mail or email, at Sponsor’s discretion. If a potential Grand Prize winner cannot be contacted within seven (7) days from the first notification attempt, then such person will be disqualified and an alternate entrant will be selected from among all eligible entries received as a potential winner. All notification requirements, as well as other requirements within these Official Rules, will be strictly enforced.

  4. PRIZES:

    One (1) Grand Prize: The Grand Prize is a trip to Los Angeles for a visit to a Marvel Studios film production set and an opportunity to be filmed during a walk-on role in a Marvel Studios film production. Trip consists of: round-trip coach air transportation for two (2) people from the major airport gateway nearest the Grand Prize winner’s residence to Los Angeles, CA; two (2) nights first-class hotel accommodations (double occupancy); a visit to a Marvel Studios film production set and an opportunity to be filmed during a walk-on role on a Marvel Studios film production (walk-on role for winner only); and, if the winner or travel companion is a licensed driver 25 years or older, or the age required by the car rental agency if the rental agency requirement is over 25 years, a car rental for up to three (3) days. Car rental type is subject to Sponsor’s sole discretion. (Approximate Retail Value ["ARV"] $2,800.00). In the event the film production is located outside of Los Angeles but still within the continental United States or Canada, then the destination city for the trip may be changed by Sponsor, in its sole discretion, to that film production location. The actual value of prize may vary depending upon the location of winner’s residence, the destination city, fares at the time of travel and the value of services rendered and products provided at the time of the travel. Therefore, the value of the prize awarded may be lower or higher at the time it is fulfilled. Any difference between the actual value and the ARV will not be awarded. Grand Prize winner and his/her travel companion must travel together to the film production location specified by Sponsor and on such dates as are specified by Sponsor (which are subject to the production schedule of the applicable film chosen by Sponsor for the walk-on role, but no later than December 1, 2008). If winner cannot travel on such dates, he/she will be disqualified and an alternate entrant will be selected as a potential winner, if time permits. Name of winner’s guest cannot be changed once ticketed. All elements of the Grand Prize trip are subject to availability and blackout periods. While the Sponsor will make every effort to provide the walk-on role, due to potential changes in production schedules, inclement weather and/or other factors not within Sponsor’s control, the walk-on role in the film is SUBJECT TO AVAILABILITY AND SPONSOR’S DISCRETION. If the walk-on role is cancelled or postponed, then all other Grand Prize elements will still be offered. There is no guarantee that the winner will appear in the finished film once it is edited. The Grand Prize winner must arrange travel with Sponsor’s agent at least 30 days in advance. Scheduled activities are subject to change. The Grand Prize winner must comply with all hotel check-in requirements, including but not limited to the presentation of a major credit card. Grand Prize winner and his/her travel companion are responsible for obtaining all necessary travel documents, including passports if the film production location is in Canada. All meals, taxes, gratuities, incidentals (including mini-bar and entertainment expenses), auto and/or travel insurance, phone charges, ground transportation, gas, tolls, parking, rental car damage and/or liability waivers, and any other expenses not specifically identified in these Official Rules as included in the prize are the responsibility of the Grand Prize winner.

    Three (3) First Prizes: (Each First Prize winner will receive only one of the following three (3) different First Prizes, to be chosen by the Sponsor in its sole discretion): One (1) Fantastic Four Omnibus book (ARV $100.00); or one (1) Spider-Man Omnibus book (ARV $100.00) or one (1) Planet Hulk Hard Cover book (ARV $40.00).

    Fifteen (15) Second Prizes: (Each Second Prize winner will receive only one of the following three (3) different Second Prizes, to be chosen by the Sponsor in its sole discretion): A 12-issue subscription to the Fantastic Four comic book series, or a 12-issue subscription to the Amazing Super-Man comic book series, or a 12-issue subscription to the Iron Man comic book series. (ARV $24.00 each). A total of five of each of these types of prizes is available.

    No transfer, substitution, or cash equivalent for all prizes is allowed except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. Please allow 6-8 weeks for delivery of the First and Second Prizes. The total approximate retail value of all prizes offered in this Sweepstakes is $3,400.00. There is a limit of one prize per person/family/household.

  5. RELEASES/TAXES: The potential Grand Prize winner will be required to execute and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (except where prohibited) (the "Affidavit/Release"). The travel companion of the Grand Prize winner must be 18 years of age or older and must also sign and return a Liability and Publicity Release. If a Grand Prize winner or his/her travel companion is deemed a minor in his/her state of residence, then the parent/legal guardian of such minor must sign any documents required herein on behalf of the minor. The Affidavit/Release must be returned by the deadline stated in such documents. If signed copies of the Affidavit/Release are not returned within that time, or if an entrant/potential winner is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner will be disqualified and an alternate entrant will be selected from among all eligible entries received as a potential winner, provided sufficient time remains prior to the Grand Prize trip, as determined by Sponsor in its sole discretion. If prizes or prize notifications are returned as undeliverable, this will result in disqualification and an alternate entrant will be selected from among all eligible entries received, if time permits. All federal, state, local and other tax liabilities (including income taxes) and like amounts in connection with a winner’s award, acceptance or use of a prize arising from this Sweepstakes will be the sole responsibility of each winner.

  6. PRIVACY: Except where prohibited by law, acceptance of a prize and/or participation in this Sweepstakes constitutes permission for the Sweepstakes Entities to use the winner’s (and his/her travel companion’s, if applicable) name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, without further compensation in connection with this Sweepstakes. Entry in the Sweepstakes constitutes consent to the transfer of the personal information collected from the entrant to the Sponsor for the purposes of administering the Sweepstakes and for such other purposes to which entrant may consent as outlined herein and in the Sponsor’s privacy policy. All information submitted to the Sponsor as part of this Sweepstakes will be treated in accordance with the Sponsor’s privacy policy, available at marvel.com/be_in_a_marvel_movie.

  7. SWEEPSTAKES CONDITIONS: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Sweepstakes Administrator and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. By entering, winners and entrants agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from: a) acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes, including, but not limited to travel b) any malfunction or other problem with the Sweepstakes Website, c) any error in the collection or retention of entry information, or d) any typographical or other error in the printing, offering or announcement of any prize.

  8. LIMITATIONS OF LIABILITY: Sweepstakes Entities are not responsible for lost, late, misdirected, garbled, undeliverable or incomplete entries due to system errors or failures, or faulty transmissions or other telecommunications malfunctions and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system errors or failures, or faulty transmissions, or for any other problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entries not received by Sponsor on account of technical problems, or any combination thereof, including other telecommunications malfunctions which may limit an entrant’s ability to participate. The Sweepstakes Entities are also not responsible for any malfunction of the entire Sweepstakes Website or error in the collection, processing or retention of entry information. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Sponsor is not responsible for incorrect or inaccurate entry of information caused by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries and are not responsible for errors in printing or presentation of the Sweepstakes.

  9. TERMINATION/SUSPENSION/MODIFICATION OFSWEEPSTAKES: If for any reason any portion of this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the Sweepstakes, then Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and to select winners by conducting a random drawing from those eligible entries received up to the termination/suspension date.

  10. DISQUALIFICATION: Sponsor may disqualify or prohibit an entrant from participating in the Sweepstakes or winning a prize in this or any other promotion conducted by Sponsor if, in its sole discretion, it determines that said entrant has violated these Official Rules or has threatened or is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor’s representatives.

  11. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
